Не так давно на собрании СО"Родина" было решено перекрыть проезд для автомобилей СО"Весеннее" , так как пыть от них мешает садоводам.
Председатель правления СО"Родина" нанял трактор и перекопал глубокой траншеей (шириной в 70-80 см , глубиной в 1м м длинной примерно в 200-250м) всю границу между обществами и в том числе дорогу ( в двух местах).
Вопрос вот в чем :
моя дочь упала в эту траншею, сломала себе руку. Ребенок , ей сейчас 9 лет, уже 7 лет болен сах.диабетом 1 типа, как осложнение - зрения осталось 40%. Девочка не бродила где-то по стройкам, она шла по дороге, по которой гуляла по несколько раз в день, и упала в канаву, так как не было ни каких заграждений или предупредительных знаков.
Есть свидетель этого происшествия. На сегодняшний день рука в гипсе уже 22 дня.
Я подала заявление в милицию, но получила отказ в возбуждении уголовного дела.
Подскажите , пожалуйста, как привлечь к уголовной или административной ответственности председателя СО"Родина"?
Просмотрев нормативные документы я узнала, что по нормам :
"Строительные нормы и правила РФ СНиП 30-02-97* "Планировка и застройка территорий садоводческих (дачных) объединений граждан, здания и сооружения"
утв. постановлением Госстроя РФ от 10 сентября 1997 г. N 18-51
5 Планировка территории садоводческого (дачного) объединения

5.1* По границе территории садоводческого (дачного) объединения, как правило, предусматривается ограждение. Допускается не предусматривать ограждение при наличии естественных границ (река, бровка оврага и др.).
Ограждение территории садоводческого (дачного) объединения не следует заменять рвами, канавами, земляными валами."
Т.е. перекапывать рвом границу обществ не следовало. Так же есть
статья 216. Нарушение правил безопасности при ведении горных, строительных или иных работ.
Как привлечь негодяя к ответственности? Ведь если человек перекапывает дорогу, не ограждая при этом это место и не предупреждая другими способами о возможной опасности для здоровья и жизни людей, что днём или ночью в длинный и глубокий ров может упасть автомобиль, человек или животное. Эти действия равносильны заминированию, протяжке оголенных проводов под напряжением, или иным мерам, умышленно предназначеных для причинения вреда здоровью или жизни людей, даже без предупреждения об опасности!!!!
Ров до сих пор не закопан, угроза существует и для других граждан.
Милиция этим заниматься отказалась. Очень надеюсь на вашу помощь.

Есть загородный дом в МО, построенный около 100 лет назад. Дом нормальный, его уже реставрировали, но он снова требует реставрации. В этом доме проживают две семьи (условно говоря) под одной крышей. То есть имеется два разных независящих друг от друга входа. В одной части дома (2/3 его части) проживает (если быть точнее, то не проживает, а отдыхает в летний период) семья на законных основаниях (имеются документы, подтверждающие право на эту часть дома, идет оформление и обновление всех документов). В другой части дома (1/3 его части) проживает посторонний человек, который не имеет никакого отношения к этой части и соответственно нет никаких правоустанавливающих документов. Семья из 2/3 дома нашла настоящего владельца 1/3 дома (это вполне адекватная бабуля 80 лет) и провела беседу о том, что в ее половине живет посторонний человек (почему он там живет это долгая история, она не имеет к делу никакого отношения). На это она сообщила, что знает об этом, но ничего предпринимать пока не намерена («знаю что живет, пусть пока живет»). Никакого договора аренды нет, более того она даже не знает этого человека и никогда с ним не общалась, а знает, что кто-то там живет. Так же ей было сообщено, что дом требует реставрации и требуется ее согласие, т.к. он находится под одной крышей. Бабуля сказала, что она инвалид 1-ой группы и никуда ездить она не будет. Буду откровенным и сообщу, что жителям 2/3 дома очень бы хотелось завладеть остальной половиной дома (хотят предложить ей выкупить 1/3 часть). Бабуле было предложено встретиться и обсудить дальнейшие действия. На что она вежливо отказалась, опять сообщив, что никаких действий предпринимать пока не будет. Сказала, что подумает и позвонить не раньше, чем через месяц.

Отсюда возникают вопросы:
1) Как лучше поступить в данной ситуации, что ей можно предложить после звонка спустя месяц?
2) Как быть с ремонтом дома, если она откажется продавать его и встретиться?
3) Интересно будет выслушать любое мнение по этой ситуации.

P.S. Конечно я понимаю, что ничего толком сделать нельзя, вроде бабуля не гонит постороннего жильца из дома и сама не живет, это ее дело в конце концов.

У фирмы нет оплаченной тоговой марки на фирменное наименование. (Сертификат на исключительное право на имя стоит порядка 40 000 р.)

Получаеться что можно зарегистрировать точно 1 в 1 такую же фирму, просто будут разные циферные номера регистрации.

Будт две одинаковые компании абслолютно в сети всеть. Что одна что другая.

Есть в интернете строчка что та фирма которая открыта первой может подать на закрытие второй так как ее дата регистрации первая.

Но не сказано ничего про то что будет если вторая фирма, открытая позже первой, вдруг получит сертификат на эксклюзивное право пользованием своим именем - патент на имя компании.

Что тогда? Возможно ли такое и может ли в этом случае первая фирма подать на аннулирование сертификата второй открытой после нее компании и может ли тогда вторая компания имеющая сертификат зпретить пользоваться своми названием первую ?

А если будут открыты 10 компаний с одинаковым именем... ?

В июне 2010 года получили Свидетельство о государственной регистрации права на земельный участок в Ленинском районе Московской области. Свидетельство заменило документы старого образца. На при этом обнаружили, что в новом кадастровом паспорте земельного участка нет его кадастровой стоимости. В кадастровой выписке о земельном участке, которую делали в марте 2010 года до получения нового свидетельства, кадастровая стоимость участка значится.

При подготовке документов к получению Свидетельства обмер участка показал меньшую площадь, чем значилась в имеющихся документах. Это было зафиксировано в акте, хозяева согласились с уменьшением площади. В Свидетельстве отражена актуальная, меньшая площадь.

Сейчас участок надо оформить с отца на сына через договор дарения. В договоре дарения должна быть указана стоимость даримого имущества. Старая кадастровая выписка о земельном участке потеряла силу.

Наша компания приняла участие в запросе котировок, который организовал Роспатент. Предложенные нами условия по цене были наилучшими, однако наша заявка была отклонена котировочной комиссией. Причиной отклонения явилось отсутствие приложенного к котировочной заявке приказа о назначения гендиректора, а также отсутствие наименования должности лица, подписавшего котировочную заявку.
А подписана наша заявка была именно гендиректором. Наша заявка была составлена по образцу, предложенному Заказчиком (там фигурировали только слова "Подпись" и "МП", и не было требования указать должность лица, подписывающего заявку), поэтому мы сочли отклонение нашей заявки неправомерным.

На следующий день после публикации протокола рассмотрения котировочных заявок мы написали жалобу в ФАС (Садовая-Кудринская, 11), которая перенаправила жалобу в Московский УФАС с формулировкой "для рассмотрения по существу". Московский УФАС вернул нашу жалобу с формулировкой "жалоба не содержит номер факса заявителя жалобы".

Это стало известно нам по телефону только на 7 день после опубликования протокола о рассмотрении котировочных заявок.

На следующий же день мы написали вторую жалобу в Московский УФАС, которая тоже была отклонена Московским УФАС, так как подана на восьмой день после появления протокола.

Мы собираемся подать на ФАС и на Роспатент в арбитражный суд, хотели бы понять наши перспективы, и именно: на чьей стороне "правда", можно ли ее добиться в арбитражном суде, какова вероятность положительного исхода и от чего она зависит.

Об этом нам сообщили вечером 25го, когда мы позвонили по телефону, причем отказались назвать причину, лишь сообщив, что жалоба отклонена. Есть соответствующее письмо, датированное 25.08

26.08 - Нами подана вторая жалоба в Московский УФАС

27.08 - Московский УФАС отправил нам почтой уведомление о возвращении первой жалобы (по штемпелю)

28.08 - Вторая жалоба отклонена по сроку давности, сообщили вечером, когда мы позвонили по телефону.

Доводы.

Наши претензии к Московскому УФАС:

1. Вместо того чтобы рассматривать жалобу "по существу", стали рассматривать по форме.

2. Просрочили сроки по ответу (2 рабочих дня с момента поступления жалобы согласно ч.2 ст. 59 ФЗ 94), тем самым лишив нас возможности повторной подачи по срокам (7 дней после публикации протокола согласно ч.2 ст. 57). Жалоба была возвращена на 6 день (4й рабочий) после подачи жалоба в ФАС и на 7 день после публикования протокола рассмотрения и оценки котировочных заявок.

Фабула дела: Компания, занимающаяся ремонтом микроволновок, предложила компании, занимающейся ресторанным бизнесом, заключить договор возмездного оказания услуг (техническое обслуживание и ремонт микроволновок). В договоре был закреплен предмет, сроки выполнения обязательств, цена и порядок приемки.

Компания-ресторан согласилась, однако выставила условие: поименовать данный договор "Договор ПОДРЯДА". Аргументы: ремонт и техническое обслуживание - это обработка вещи, что, в соответствии со ст. 703 ГК РФ, является предметом договора подряда.

Компания-ремонтник возразила, что в предмет договора входит техническое обслуживание, которое включает, в том числе, диагностику и чистку. Это действия не направлены на обработку вещи, не изменяют материальный объект, а потому договор должен быть поименован "Договор ВОЗМЕЗДНОГО ОКАЗАНИЯ УСЛУГ".

В итоге компании заключили договор, назвав его договором возмездного оказания услуг.

Вопрос: а кто на самом деле прав? Является данный договор договором подряда или договором ВОУ?

И пусть даже он назван "Договор возмездного оказания услуг" - будет ли это влиять на то, в каком качестве будет суд рассматривать этот договор? Имеется ввиду случай, если возникнет спор.

2. Как зафиксировать момент завершения работ?

Фабула дела: Между двумя компаниями был заключен договор подряда на ремонт помещения - меняли плинтус, линолеум и т.п. В договоре содержались условия о предмете (прилагалась смета и график работ), цене, сроке, качестве и неустойке за просрочку обязательства. Подрядчик сроки провалил, работы завершил с опозданием.

Подрядчик уже выставил акт сдачи-приемки и счет-фактуру. Акт сдачи-приемки составлен в вольной форме (не КС-2) - кстати, является ли это нарушением? Бухгалтерия утверждает, что является. Акт ещё не подписан.

Вопрос: каким образом зафиксировать момент фактического завершения работ? Ведь приемка может осуществляться и по истечении определенного срока. А требуется зафиксировать момент, когда работы были объективно завершены - разумеется, для исчисления неустойки.

Я всетаки хочу лишить его родительских прав, но не знаю как это сделать. Как только я завожу эту тему он начинает мне угрожать, ссылаясь на то, что ему в этой жизни уже нечего терять и он не боится снова попасть в места столь отдаленные. Я бы решилась на этот процесс, но боюсь за своих родителей - они живут с ним в одном городе.

Суд мы проиграли. Долг выплатил солидарно один из ответчиков - ООО. Сейчас нам ООО выставляет регрессные требования. Нас всего было трое ответчиков, ООО все заплатило теперь - к нам. Не знаю как уйти. какие-то есть лазейки? Хочу признать иск частично - суд. арсходы на оплату предсатвителя - 9 тыс. рублей буду заявлять как завышенные. Она утверждает, что ее отец был на иждивении у моей мамы - но документально это нигде не зафиксировано( тем более, что мама сама нуждалась в уходе). Может ли он по закону действительно находиться на иждивение у больной матери? И являлся ли он после смерти мамы наследником обязательной доли? И влияет ли, тот факт, что он не вступил официально в наследство?
